A wrongful death action seems to fly in the face of convention. Under common law, a deceased individual, due to the obvious inability to file a lawsuit on his/her own behalf, had no course of recovery for the harm that resulted in death. Therefore, a legal loophole arose. It was necessary to create laws that would address the issue of wrongful death to allow those harmed as a result of a loved one's death an opportunity to recover for damages sustained. The standards of proof are significantly different when comparing a criminal action to a civil action. The standard of proof for a criminal action is "beyond a reasonable doubt." The standard of proof for a civil action is "preponderance of the evidence." (In the United Kingdom, the standard of proof is the "balance of probabilities.") In many instances, lawsuit loans may be procured to assist individuals who wish to bring a civil action in an effort to recover damages sustained. The higher the standard of proof, the more difficult it is to prove your claim, A criminal action, requiring the highest standard of proof (beyond a reasonable doubt), is a most difficult case to bring. Remember, the two causes of action are not mutually exclusive. Illustrative of this is the OJ Simpson trial. The individual responsible for causing your loved one's death may be pursued criminally, viz., in a criminal court. That individual may also be pursued in a civil action for the same conduct. When you pursue a civil action against that individual, the lawsuit loan may prove extremely helpful. A wrongful death cause of action is the only recourse when your loved one's death is caused by a company, not an individual. An example of a company causing a loved one's death would be that of the tobacco companies. It should be noted that many families over the years have attempted to pursue tobacco companies criminally, with little to no success. Contrariwise, many have found success in pursuing wrongful death claims against tobacco companies. Remember, although the grief may be overwhelming, your expenses do not stop mounting that. Additionally, your expenses medically May be greater due to the fact that your loved one is no longer around to assist in meeting family expenses.
